\n\u00abRadio Era\u00bb and the CF\u00a0\u00abPatients of\u00a0Ukraine\u00bb won the court case filed by\u00a0the Association Pharmaceutical Manufacturers of\u00a0Ukraine for allegedly dissemination of\u00a0false information. The Economic Court of\u00a0Kyiv published the corresponding decision.<\/p>\n

The point is\u00a0that the Association Pharmaceutical Manufacturers of\u00a0Ukraine with its President Petro Bagriy, which is\u00a0the known \u00abfrontrunner\u00bb of\u00a0the tenders organized by\u00a0the Ministry of\u00a0Health, accused the patients organization and the mass media in\u00a0dissemination of\u00a0false information, which allegedly asserted a\u00a0negative influence on\u00a0the activities of\u00a0the Association (Article 201 of\u00a0the Civil Code of\u00a0Ukraine).<\/p>\n

\u00abThis is\u00a0an\u00a0absurd situation. The rampant corruption everywhere in\u00a0Ukraine is\u00a0a\u00a0well-known fact. Our country is\u00a0riddled with the corrupt practices ranging from registration of\u00a0the medicines to\u00a0conducting state tenders. Quite telling is\u00a0the fact that no\u00a0name of\u00a0any company was mentioned in\u00a0the interview, but the Association for some reason took it\u00a0personally. This is\u00a0a\u00a0case, where the guilty mind is\u00a0never at\u00a0ease. But in\u00a0no\u00a0circumstances anyone will stifle the truth by\u00a0courts or\u00a0threats\u00bb,\u00a0\u2014 says Olga Stefanyshyna<\/strong>, the Executive Director of\u00a0the CF\u00a0\u00abPatients of\u00a0Ukraine\u00bb.<\/p>\n

As\u00a0a\u00a0reminder, on\u00a0November\u00a023, 2015 in\u00a0her comments to\u00a0the Radio Era Olga Stefanyshyna, the Executive Director of\u00a0the CF\u00a0\u00abPatients of\u00a0Ukraine\u00bb told about a\u00a0new system of\u00a0the state procurements of\u00a0medicines and vaccines through the international organization and touched upon registration of\u00a0the medicines in\u00a0Ukraine. Subject of\u00a0action was the phrase \u00abThe Ukrainian companies are accustomed to\u00a0buy certificates for selling their products and to\u00a0sell the medicines, whose quality is\u00a0not confirmed by\u00a0the laboratory examination\u00bb.<\/p>\n

The court of\u00a0the first instance rejected the claim of\u00a0the Association Pharmaceutical Manufacturers of\u00a0Ukraine<\/a>. The pharmaceutical manufacturer filed an\u00a0appeal trying to\u00a0settle a\u00a0dispute by\u00a0the out-of-court settlement. Radio Era and the Charity Fund Patients of\u00a0Ukraine did not violate any legislative provision, so\u00a0they rejected the out-of-court settlement.<\/p>\n

\u00abInformation presented in\u00a0the program is\u00a0important for the public and outweighs the potential damage from its dissemination. Moreover, this phrase is\u00a0extracted from the context of\u00a0the information program. Talking about imputation of\u00a0the pharmaceutical market players is\u00a0overreaction because none of\u00a0the pharmaceutical companies were mentioned in\u00a0the Program. It\u00a0means that no\u00a0business reputation discredit took place\u00bb,\u00a0\u2014 reports the representative of\u00a0the Radio Era<\/strong>.<\/p>\n

On\u00a0March 22\u00a0the Kyiv Economic Court of\u00a0Appeal rejected the claim of\u00a0the Association Pharmaceutical Manufacturers of\u00a0Ukraine.<\/p>\n

CF\u00a0\u00abPatients of\u00a0Ukraine\u00bb is\u00a0the organization, whose goal is\u00a0to\u00a0provide all patients of\u00a0Ukraine with the effective treatment by\u00a0uniting the activists for influencing the state laws and policy.<\/p>\n

As\u00a0a\u00a0reminder, the Association Pharmaceutical Manufacturers of\u00a0Ukraine is\u00a0headed by\u00a0Petro Bagriy, who only last year won\u00a095% of\u00a0the tenders for procurement of\u00a0medicines for hepatitis patients.<\/p>\n
